Terms and Conditions

Nature contents conditions & value of consignments are unknown to SKT Logistics Pvt Ltd (Herein after called as SKT) carries the goods in as it is conditions packed by the consignor and entirely at the owner’s or booking agent risk.

The SKT Shall not be liable for any loss or damage due to natural calamity, theft, whether conditions, strikes, riots, disturbances, fire, explosions, and accidents and due to the circumstance beyond our control

The consignor/consignee shall be responsible for any delay, detention loss or forfeiture of goods by government authorities; –

If the consignor makes a wrong declaration about the contents of (2) if transport of such goods by the road is prohibited or such goods are not accompanied by proper documents such as invoice, road permits etc are declaimed by any statutory authorities. Expenses incurred if any, by the SKT in this connection shall be borne by the consignor/consignee only.

The consignor will have to deal directly with detained departments or any other statutory authorise for wrong declaration etc, and SKT will not be held responsible.

Fresh fruits, furniture, crockery, glassware and the other such delicate goods are booked at the absolute risk of the consignor & the SKT shall not be responsible for any damage during the transit.

SKT will have all the rights to dispose of the perishable article lying undelivered after 48 hour of arrival without any notice and other goods after 30 days of arrival after due notice in writing to the consignor/consignee and the consignee shall be entitled to the proceeds less freight demurrage and other charges if any.

The goods will be delivered at the destination at the godown only unless stated otherwise in writing on the goods consignment note itself against payment of all charges. The consignee shall arrange to take the delivery of the consignment form the godown.

If the consignment is booked on Door Delivery basis, SKT will attempt only once to deliver the goods at the Consignee’s door. If the party fails to accept the goods when approached for delivery at their door or in case of found door locked the goods will be kept at its delivery office and if the consignee wants the goods to be door delivered, additional door delivery charges and storage as applicable shall be paid by the consignee.

The delivery of the consignments should be taken by the consignee within 7 days of its arrival at original delivery destination/Intervening SKT Godown , failing which the godown charges of Rs.30/- per quintal or Rs.30/-carton box of TV/Refrigerator/Washing machine & any other bulky/voluminous carton box & Rs.10/- per carton box for all other consignments per day will be charged. The arrival of the consignment shall be ascertained by the Consignee only.

Hamali & Miscellaneous charges are payable at delivery point in addition to the freight charged mentioned in the GC.

SKT shall have all the rights to exercise general lien over all shipments of the parties towards any dues payable to the SKT

If the delivery is not taken within prescribed, the consignment will be treated as unclaimed and will be sent to unclaimed property section at Peenya-Bengaluru for further disposal.

Once the consignment is moved to unclaimed property section at Peenya, Bengaluru Godown, Karnataka, storage charges shall be charged @ 12% on thedeclared value of the Consignment from the date of arrival at original delivery destination/intervening’s Godown.

SKT shall not be liable for alleged wrong deliver of the goods, once the goods are delivered against the relative waybill to the person supposed to be entitled or authorised to take delivery there at.

When a bank agrees to accept this Lorry Receipt as a document of title to the goods hereby carried & has become entrusted by way of bailment or endorsement of the lorry receipt whether before or after the entrustment of the goods to the carriage. SKT hereby agrees in consideration of the same to hold themselves liable and shall be deemed to hold themselves liable at all material times directly to the bank concerned as if the bank were the party to the contact herein contained with the right of recourse against to the extent of the Bank’s interest in terms the provision of the carriage by Indian Road Act 2007 & Rules, 2011 against any or all risk of physical and or damaged under any circumstances what so ever & to Indemnify or pay to the bank to the extent stated in the said Act, without reference to the Consignee or the owner of the goods carried notwithstanding the right to immunity. If any from the liability for such loss or damage on any ground whatsoever as against consignor, consignee, or owner on contract between them. The bank shall have the right to recover a claim directly from the SKT.

SKT has all the rights to re-weight, res-measure, reclassify & recalculate the freight & other charges at the place or destination in the presence of the holder of the receipts or his duty authorised agent & collect the same from the consignee before delivery.

No Complaints, claims or enquiries of any kind will be entertained relating to any consignment after 7 days from the date of delivery and 30 days from the date of booking whichever is earlier

The courts in Bengaluru alone shall have the Exclusive Jurisdiction in respect of all claims & matter arising out of the transaction.

Any notices related to this waybill from Sales Tax authorities/Statutory authorities should be cleared by the consignor/consignee only.

The Consignment of Explosives, crackers, Gas Cylinders (Filled/Empty) Acid, Liquid contents, chemicals in oil forms liquid or powder & contraband articles, any NDPS items etc. shall not be booked by the SKT.

If the parties are inclined to get the Consignment rebooked, consignment will be rebooked on “as is where is condition” from Peenya-Bengaluru and will not be responsible in case of any damage at the time of rebooked consignments. Additional conditions in case of Carriers Risk contract

Nature, contents, condition & value of the consignments as declared by the consignor to the transport Operator are specified in this consignment note. The Transport Operator carries the goods as packed at Carriers Risk at an additional freight of Rs.1% per thousand on value declared by the consignor having been charged & paid.

The very acceptance of the consignment does not bind the consignor to all the Terms & conditions & signature on the face of the Consignment note is not essential.

SKT Operates on “Best effort Basis” & no commitment is made on time bound completion of Services.

Free storage for 7 days is allowed on each consignment at destination on arrival after which storage charges will Apply @ 0.15 per kg per day.
